1. The store

These terms govern your use of this website and any order request you send to Mesomorpheus LLC, 2897 Mapleton Ave Ste 700, Boulder, CO 80301-1112, United States, company number 20181594609. The goods are exercise resistance bands and training mats: long rubber exercise loops, a fabric hip resistance band, and training, fold and mobility mats.

Mesomorpheus LLC sells exercise equipment. The bands are training tools. They are not fitness trackers, smartwatches, jewellery or medical devices. Mats are for floor work, not for a promise of results.

2. Using the site

You may browse the catalogue, save a bag in this browser, and send an order request. You agree not to misuse the site: do not attempt to break it, scrape it in a way that degrades it for other people, or send a request you do not intend us to read.

The site is offered in English for customers in the United States. Catalogue prices are in US dollars.

3. The catalogue

Photographs, colors and descriptions help you choose. They are not a specification by themselves. Choose a band by the movement you can control, not by the strongest label. Choose a mat by the floor space and storage you actually have. Ask for dimensions and resistance notes before you pay if you need them.

A price on a product page is a catalogue price. It can change until we confirm your request. We do not hide a higher price after you have paid the amount we confirmed.

4. Order requests

Sending checkout information is an invitation for us to confirm an order. It is not an acceptance, and it does not reserve stock by itself. We accept an order when we send confirmation of the items, the total in US dollars, the delivery arrangement and the payment instructions, and you pay that amount.

We may decline or ask for clarification if an address is incomplete, a size or model is missing, a note contradicts the product, or we cannot supply the item. We will say so rather than take payment for something we cannot send.

5. What you are responsible for

• The accuracy of your contact details, address and any measurement, model or size note.
• Keeping the confirmation email, and paying only in the way that email describes.
• Receiving the goods, or telling us promptly if the address or the receiving hours will not work.
• Using exercise resistance bands and training mats as ordinary goods of that kind, and following any note we send about care or limits.

Inspect equipment before the first session. Stop using a band that is nicked or a mat that no longer lies flat, and write to us rather than sending a damaged item without asking.

6. Our materials

The text, layout, photographs and name of this store are owned by the business or used with permission. You may not copy the catalogue for your own shop. You may share a link to a product page.

7. Limits

Until an order is accepted, the site and the catalogue are provided as a way to send a request. We are not liable for a decision you make from a photograph alone, or for a delivery date that was never confirmed.

Once an order is accepted, if we fail to supply the goods as confirmed, or the goods are materially not as described, your remedy is a resupply or a refund of the amount you paid for those goods and, where the fault is ours, the delivery charge. We are not liable for indirect or consequential loss, to the extent US law allows that limit. Nothing here limits liability that cannot legally be limited, including liability for death or personal injury caused by negligence where the law forbids that limit.

Exercise resistance bands and training mats are ordinary consumer or trade goods as described on the page. They are not sold as medical devices, safety equipment, or a guarantee of a particular outcome.

8. Which law applies

These terms are governed by the laws of the State of Colorado and the federal law of the United States that applies, without using conflict-of-law rules to point somewhere else. Courts in the State of Colorado may hear a dispute, except that you may also use a small-claims court that has authority over your claim. If you are a consumer, you keep any non-waivable right your state of residence gives you.

9. Changes

We may update these terms by posting a new version on this page with a new date. The version in force when we confirm your order is the version that applies to that order. A change does not rewrite an order already paid.

10. The rest of the paperwork

The shipping policy, returns policy, payment policy, privacy policy and cookie policy are part of how the store operates. If a confirmation email states a delivery charge, a cut length or a size, that email controls for that order.
